Terms of Use.
The agreement between you and RestWell governing your use of the platform.
§ 01Acceptance
By accessing or using the RestWell platform (the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.
§ 02Description of service
RestWell provides digital cemetery management tools, including plot record digitization, interactive cemetery mapping, booking and scheduling, virtual memorial page creation, and related features. The Service is delivered via web application and this website.
§ 03Accounts
You must create an account to use RestWell. You are responsible for maintaining the security of your credentials and for all activity under your account. You must provide accurate information and keep it current. Cemetery administrators are responsible for managing staff access within their organization.
§ 04Acceptable use
You agree to use RestWell responsibly and lawfully. You will not enter knowingly false interment or plot records, attempt to compromise the platform’s security, use the Service to harass or defame individuals through memorial pages, or use the platform for any purpose unrelated to cemetery management.
§ 05Platform disclaimer
RestWell is a record-keeping and management tool. It is not a substitute for official municipal or county burial records, and digitized records should be verified against original sources where legal compliance requires it. You are solely responsible for the accuracy of data you enter and for decisions made using the platform.
§ 06Your data
You retain ownership of the cemetery records, memorial content, and operational data you create. You grant RestWell a limited license to process, store, and display your data to provide the Service. You may opt in to allow anonymized, aggregated data for platform improvement; opt-in is off by default and may be withdrawn at any time.
§ 07Intellectual property
The RestWell platform — including software, design, mapping tools, and branding — is owned by RestWell. You may not copy, modify, reverse-engineer, or attempt to extract proprietary components without written permission.
§ 08Subscriptions
Paid plans are billed monthly or annually depending on the plan you select. You may cancel at any time from your account settings; access continues through the end of the billing period. Refunds are handled case by case. Prices may change with at least 30 days’ notice.
§ 09Limitation of liability
The Service is provided “as is.” We make no warranties about the completeness or accuracy of digitized records beyond what was provided during onboarding. To the maximum extent permitted by law, RestWell is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including any damages related to record-keeping errors, scheduling conflicts, or operational decisions.
§ 10Termination
We reserve the right to suspend or terminate accounts that violate these Terms. You may delete your account at any time. Upon termination, we will provide a full data export upon request within 30 days.
§ 11Changes
We may revise these Terms from time to time. We will provide at least 14 days’ notice of significant changes. Continued use after changes take effect constitutes acceptance.
